Universal’s case against Grooveshark has come back to court. Universal accuse Grooveshark of hosting shedloads of unlicensed music (true). Grooveshark contends that as it is a user-upload site they have no control over content, and operate a take-down system when alerted to copyright infringement (also true). While Grooveshark is hardly pro-active in checking whether uploads are legal or not – and many of them aren’t – the law appears to be on their side. However, Universal are attempting to at least secure part of their catalogue by using a technicality that may make it illegal for Grooveshark to host any music released before 1972
